AAPD 22-03: Verification of Eligibility for the 8(a) Program
Subject: Acquisition
I. Purpose: The purpose of this AAPD is to inform the USAID acquisition workforce of updates to the process for issuing awards under the 8(a) Business Development Program (8(a) Program). These updates are necessary due to a recent U.S. District Court injunction1, as well as related guidance issued by the Small Business Administration (SBA), in consultation with the Department of Justice (DOJ).
II. Required Actions: Prior to making an award under the 8(a) Program, the Contracting Officer (CO) must take the steps outlined in the “Required Actions” of the AAPD to verify the business’ eligibility as socially disadvantaged. This verification is in lieu of using the System for Award Management for determining 8(a) eligibility or presuming acceptance of a requirement by the SBA.
