CIB 94-09: Sunday Pay for U.S. Personal Services Contractors

This CIB cancels and supersedes CIB 92-14 dated October 21, 1992.
Effective immediately, each Mission has the option whether or not to authorize Sunday pay for U.S. PSCs, with two stipulations: 1) the decision whether or not to pay must be administered consistently throughout the Mission; 2) if Sunday pay is authorized, it must be paid under the same terms and conditions that non-commissioned Foreign Service direct-hire employees would receive such pay. For example, a PSC employee whose basic rate of pay exceeds the maximum GS-15 rate would be ineligible and the maximum limitation on compensation of 3 FAM 231.5-1 would apply.
Retroactive compensation for PSCs who did not receive the benefit during initial negotiations of their contracts is not authorized. Sunday pay is only applicable to new contracts, extensions, renewals or other amendments where there is consideration to the Government. TCN and CCN PSCs will continue to receive compensation in accordance with the provisions of their respective compensation plans.
